Success for Black Fox Metalcraft in Copyright Dispute

Virtuoso Legal recently acted for Black Fox Metalcraft Limited, who are a well-known metalwork designer and manufacturer in the Cheshire area (please see their fantastic designs here: https://www.blackfoxmetalcraft.co.uk/), in relation to defending the copyright in their prized weathervane designs.

In September 2015, the directors of Black Fox discovered that several of their weathervane designs were being offered for sale on another company’s eBay page.  As can be seen from the below, the other company’s designs were identical to Black Fox’s designs.

Comparison of Designs

Black Fox quickly contacted the seller to see if there had been a mistake, but received no response.  Black Fox then wrote a formal letter to the company, but Black Fox’s pleas for their designs to be removed from sale fell on deaf ears.

At this point, the directors of Black Fox sought the assistance of the team of intellectual property experts at Virtuoso Legal, who prepared formal court proceedings in relation to copyright infringement against both the seller company and its directors.  As a result, the seller agreed to cease all use of Black Fox’s intellectual property, remove all the above designs from any publications, and to pay Black Fox a sum in relation to damages and legal costs.

Black Fox Metalcraft are now content in knowing that their prized weathervane designs are not being sold by another company, as well as having their legal costs paid by the other side.
